The Most Important Document You Never Heard Of
You checked the views, the pool, and the kitchen. But did you check the "Licença de Utilização"?
WHAT IS IT? The Use License (or Habitation License) is a document issued by the Town Hall (Câmara Municipal). It certifies that the property was built legally and is fit for habitation.
THE RISK: Without this license, you cannot:
- Get a mortgage from most banks.
- Legally rent the property to tourists (Alojamento Local).
UPDATE (September 2026): Since 2024 the licence no longer has to be shown at the deed. From 1 October 2026, the deed must state whether a use licence exists; if it does not, the sale can be annulled. Checking it before you sign is more important than ever.
A COMMON TRAP: Beware of properties listed as "storage" or "commercial" being sold as apartments. If the license doesn't say "Habitation," you are buying a problem, not a home.
