Buying a New Build? You Are Protected for 10 Years
If you are buying a newly built property or a fully refurbished home in the Algarve, Portuguese Law offers you strong protection against defects when the seller is a professional (a developer or builder).
THE NEW RULES: For contracts signed recently, the warranty periods have increased:
Structural Defects: The guarantee is now 10 years (previously 5). This covers issues that affect the stability of the building (foundations, walls, roof).
Other Defects: For non-structural issues (like plumbing, electrics, or finishes), the guarantee is 5 years.
HOW TO CLAIM: If you find a defect, you must report it to the builder (in writing, via registered letter) within specific deadlines. Do not just call them; you need proof of the complaint.
